1. APPLICABILITY OF TERMS AND CONDITIONS
These Terms and Conditions shall apply to all orders made via the website of MATRIX Basel. Customers are bound by the version published on the website at the time of the order. The Terms and Conditions are subject to change at any time. Further, unless covered by these Terms and Conditions, the relevant provisions of the Swiss Code of Obligations apply.

2. TERRITORY
At present, products purchased in the MATRIX Basel online shop can be delivered worldwide.

3. PRICES
The offer is valid while stocks last. All prices are in Swiss Francs and include the current applicable VAT rate of 8.1%. Any increase in VAT shall be borne by the customer. MATRIX Basel will charge a delivery fee based on the price of the order, regardless of the number of items (see 6. Delivery).

4. CONCLUSION AND TERMINATION
All offers and prices on the MATRIX website are non-binding. By submitting an order via the website, the customer makes a binding offer. MATRIX Basel confirms acceptance of the offer by email to the customer. Only with this express acceptance does a contract take effect which entitles the customer to delivery of the goods. If the goods ordered by the customer are not available in the desired quantity or to the price indicated on the website, MATRIX Basel will notify the customer as soon as possible. In this case, the contract is not valid until the customer has confirmed the corrected order per email. In the event of spelling, typing, or calculation errors on the website, MATRIX Basel has the right to withdraw at no cost.

5. PAYMENT
Payment is made via Credit Card, Paypal or Twint. Bank transaction fees are paid by the customer. All other payment methods are subject to charges. These charges differ depending on the company (VISA +2.7%, MasterCard +2.7%). Credit card details are transmitted via a secure HTTPS connection provided by Stripe. You will receive a confirmation from Stripe when the transfer has been completed.

6. DELIVERY
Goods are generally delivered within 2-4 working days (Switzerland) and up to 8 working days (other countries). Benefit and risk shall pass to the carrier and the customer when the goods are handed over to the carrier. No customs duties have been paid. Deliveries abroad are subject to customs duties and the import tax of the destination country; these costs shall be paid by the customer upon receiving the goods. Example: +19% of the product price for Germany, +20% of the product price for Austria etc.

7. RETENTION OF TITLE
Pending full payment of all claims against the customer, the delivered goods shall remain the property of MATRIX Basel.

8. RETURNS
The customer has the right to return the goods within 5 working days upon receipt. Discounted items cannot be returned. Goods that have been damaged by accident, improper handling, neglect, self-repair, or normal wear and tear cannot by returned. The right to return goods is only effective if the goods are returned within 5 working days unused, intact, complete and in the original packaging. Upon receipt of the returned goods in the described condition, MATRIX Basel will reimburse the purchase price of the goods. MATRIX Basel will not assume the postal charges for the return delivery. The goods can be returned to the following address at the expense and at the risk and benefit of the customer: MATRIX Basel, St.Johanns-Vorstadt 38, CH 4056 Basel Delivery fees for the original order will not be refunded.

9. WARRANTY
MATRIX Basel guarantees delivery of the goods in good order and condition. Should goods nevertheless be defective, the customer must report the defects in writing within 5 days of delivery. Once the defective goods have been returned, they will be repaired or replaced. If replacement is not possible, MATRIX Basel shall refund the amount paid. MATRIX Basel will NOT repair or replace items that have been damaged due to the fault of the customer. Claims for cancellation of the order, price reduction or compensation for consequential damage are excluded to the extent permitted by law. Alterations made by the manufacturer in the outward form of the product (e.g. packaging) do not constitute a defect. Images on the website are for illustration only and are not binding. In the case of improper use of the goods, the customer loses any rights relating to a defect.

10. DATA PROTECTION
All personal data provided by the customer shall remain strictly confidential and be used by MATRIX Basel only.

11. DATA SECURITY
Appropriate security technology is employed to protect customer data against unauthorised processing. However, we are unable to accept liability for the security of data transmitted via the internet. Data is transmitted in encrypted form.

12. GOVERNING LAW AND JURISDICTION
All contracts concluded via the MATRIX Basel website are governed by Swiss law. In the case of orders made by private individuals for private use, jurisdiction is determined by the Federal Act on Civil Jurisdiction. In all other cases, Basel is the exclusive place of jurisdiction.
